1. Definitions

In these Terms of Service (the Terms):

  • Trojan means the business operating the Website under the trading name “Trojan”.
  • User, you and your mean any person or entity that accesses or uses the Website.
  • Content means all text, images, graphics, logos, videos, designs, layouts, software, data, and other materials available on or through the Website.
  • Services means the information and enquiry functionality provided via the Website in relation to Trojan’s strip‑out and related services, and any other online services Trojan makes available from time to time.

If you continue to use the Website after any changes to these Terms take effect, you will be deemed to have accepted the updated Terms in accordance with section 14.

  • Eligibility. The Website is intended for persons aged 18 or over. By using the Website, you confirm you are at least 18 years old. Trojan does not knowingly collect personal data from children under 13.
  • Permitted use. You may use the Website only for lawful purposes and in accordance with these Terms.   • Prohibited conduct. You must not:

4. Enquiries, Estimates and Contracts for Services

  • Enquiries. The Website may allow you to submit enquiries or request a call-back or estimate. Submitting an enquiry does not create a contract. Trojan may contact you to discuss your requirements.
  • Estimates. Any estimate provided through or following use of the Website is indicative only and subject to survey, scope confirmation, and written agreement on final terms.

If you decide to procure services from Trojan, the terms governing those services (including scope, pricing, warranties, and liabilities) will be set out in a separate written agreement.   • You grant Trojan a worldwide, non-exclusive, royalty-free licence to use, host, store, reproduce, modify, and communicate your User Content as reasonably necessary to operate the Website and respond to your enquiry.
  • Trojan may remove any User Content that it reasonably considers to breach these Terms or applicable law.

8. Disclaimers

  • No waiver of statutory rights. Nothing in these Terms affects your statutory rights that cannot be excluded or limited under applicable law.

9. Liability

  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
  • Subject to the paragraph above, Trojan will not be liable to you for:
    • any loss of profits, sales, business, revenue, or anticipated savings;
    • business interruption, loss of business opportunity, goodwill, or reputation;
    • loss or corruption of data or information; or
    • any indirect, consequential, or special loss or damage, in each case arising out of or in connection with your use of, or inability to use, the Website or reliance on any Content.
  • Subject to the first paragraph of this section, and to the extent permitted by law, Trojan’s aggregate liability to you arising out of or in connection with the Website and these Terms shall be limited to the greater of £100 or the total amount (if any) paid by you to Trojan in the 12 months immediately preceding the event giving rise to the claim for access to paid Website features (if any).

  • Controller. Trojan is the controller of personal data processed via the Website.

  • Assignment. You may not assign or transfer your rights or obligations under these Terms without Trojan’s prior written consent. Trojan may assign or transfer its rights and obligations to another organisation, for example in connection with a business transfer, merger, or restructuring.
  • Interpretation. Headings are for convenience only and do not affect interpretation. References to “including” are deemed to mean “including without limitation”.
